Terms of Use

These Terms of Use (“Terms”) govern your use of the website marbyte.dev and the mobile applications published under marbyte.dev (together, the “Services”). In these Terms, “we”, “us”, and “our” refer to the operator of marbyte.dev, and “you” refers to you, the user.

By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. License to use the apps

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use our apps on devices you own or control, for your own personal, non-commercial use, in accordance with these Terms and with the rules of the store you downloaded them from.

Apps downloaded from the Apple App Store are also subject to Apple's Licensed Application End User License Agreement (the “Standard EULA”). Where Apple's store terms conflict with these Terms for a given app, Apple's terms apply to the matters they cover.

2. Purchases, subscriptions, and renewals

Some apps offer paid features through in-app purchases or subscriptions.

• Billing. All purchases are processed and billed by Apple through the App Store — not by us. We do not receive or store your payment details.
• Auto-renewing subscriptions. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. The price and billing period are shown to you before you buy.
• Managing and cancelling. You manage, cancel, or change subscriptions in your Apple ID account settings — not inside the app. Deleting an app does not cancel a subscription.
• Restore purchases. Where applicable, you can restore previous purchases using the “Restore Purchases” option in the app.
• Refunds. Refunds are handled by Apple under its own policies. We do not process payments and generally cannot issue refunds directly; please contact Apple.
• Free trials. If an app offers a free trial, any unused portion is forfeited when you buy a subscription, where Apple applies that rule.

3. Acceptable use

You agree not to:

• use the Services for any unlawful purpose or in violation of any applicable law;
• copy, modify, distribute, sell, or lease any part of the Services;
• reverse engineer, decompile, or attempt to extract source code, except to the extent the law expressly permits;
• interfere with, disrupt, or attempt to gain unauthorized access to the Services or their systems;
• use the Services to harm, harass, or infringe the rights of others.

4. Intellectual property

The Services, including their software, design, text, graphics, logos, and the marbyte.dev name and branding, are owned by us or our licensors and are protected by intellectual-property laws. Except for the license granted above, these Terms do not give you any rights in the Services.

5. Disclaimers

The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

Our apps are tools for everyday use. They are not a substitute for professional advice. Nothing in the Services is intended as medical, legal, financial, or other professional advice, and you should not rely on it as such.

We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected.

6. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Services.

To the extent liability cannot be excluded, our total liability to you for any claim relating to the Services is limited to the greater of (a) the amount you paid us for the relevant app in the 12 months before the claim, or (b) USD 50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

7. Third-party services and links

The Services may rely on or link to third-party services (such as the App Store, analytics, crash-reporting, and notification providers). We are not responsible for the content, policies, or practices of third parties. Your use of their services is governed by their own terms.

8. Termination

You may stop using the Services at any time. We may suspend or end your access to the Services if you breach these Terms or if we discontinue an app. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

9. Apple-specific terms

For apps downloaded from the Apple App Store, you acknowledge that:

• These Terms are between you and us only, not with Apple, and Apple is not responsible for the apps or their content.
• Apple has no obligation to provide maintenance or support for the apps.
• In the event of any failure of an app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the apps.
• Apple is not responsible for addressing any claims relating to the apps, including product-liability, legal/regulatory, or consumer-protection claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we'll change the “Last updated” date above. Continued use of the Services after an update means you accept the revised Terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which the operator of marbyte.dev is established, without regard to its conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have where you live. If a dispute arises, please first contact us at support@marbyte.dev so we can try to resolve it directly.
